Opgericht op 1 oktober 1838 bij inwerkingtreding van de Wet op de rechterlijke organisatie. Een voorloper, de Hoge Raad in Den Haag tijdens de Republiek, bestond al vanaf 1581.

De Hoge Raad is sinds 1838 het hoogste gerechtshof in Nederland voor civiel recht, strafrecht en belastingrecht. In cassatie beoordeelt de Hoge Raad alleen of de lagere rechter het recht juist heeft toegepast — feitenvaststelling is slotzaak. De Raad bewaakt daarmee rechtseenheid. Vanwege grondwettelijke onafhankelijkheid staat de Hoge Raad buiten de RvR-koepel; financiering loopt rechtstreeks via een eigen artikel op de JenV-begroting.
